These are the terms and conditions governing your use of the Site (“hereinafter referred to as the Acceptable Use Policy or AUP).

By accessing Himalayas Digital through the website, you acknowledge, accept and agree to the following terms of the AUP, which are designed to ensure that Himalayas Digital works for everyone. This AUP is effective from the time you log in to Himalayas Digital. By accepting this AUP, you are also accepting and agreeing to be bound by the Privacy Policy.

1. Using Himalayas Digital

You agree and understand that www.himalayasdigital.com is an internet-enabled electronic platform that facilitates communication for the purposes of advertising and distributing information pertaining to goods and/or services. We do not endorse, market or promote any of the listings, postings or information, and we do not at any point in time come into possession of or engage in the distribution of any goods and/or services posted or listed on the Site.

While interacting with other users, you are encouraged to exercise reasonable diligence and use judgment before committing to any sale, purchase or exchange of information. We recommend that you read our safety tips before engaging in any activity on the Site.

When using classifieds and other services such as events, stories, blogs, TV, discussion forums, comments, feedback and other features, you agree to post content in the appropriate category or area and to use the Site strictly in accordance with this AUP.

Your listing, posting and/or information must not:

• Pertain to goods or services that you do not own or do not have authority to list.
• Belong to another person without the required rights.
• Be defamatory, obscene, pornographic, harassing, libellous, racially objectionable or otherwise unlawful.
• Be fraudulent, misleading, illegal, counterfeit or involve stolen goods/services.
• Be harmful to children or violate any intellectual property rights.
• Violate any law for the time being in force.
• Impersonate another person or threaten national security or public order.
• Contain viruses, malware or code intended to disrupt the Site.
• Contain spam, chain letters, pyramid schemes or unfair trade practices.
• Be placed in the wrong category or in a city/location other than where you are located.

If you are registered on the Site, you are responsible for maintaining the confidentiality of your user ID, password and email address, and for all activities that occur under your account.

Sellers must provide complete and accurate information such as the price of goods/services, applicable taxes, mandatory notices, relevant details of the goods/services, the name and contact details of the grievance officer, physical address, and rating/feedback information.

2. Eligibility

Use of the Site, either by registration or otherwise, is available only to persons who are citizens of India, are 18 years of age or older, and who can enter into a legally binding contract. If you access the Site on behalf of a legal entity, you represent that you are fully authorized to do so.

3. Content

The Site contains content including your information, Himalayas Digital information and information from other users. You agree not to copy, modify or distribute such content except as permitted. When you provide content as part of your information, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right and license to use, reproduce, publish, translate, distribute, perform and display such content worldwide through the Site and related platforms.

We reserve the right to remove any content where we have grounds to suspect a violation of these terms, our Privacy Policy or any applicable law.

4. Liability

You agree not to hold Himalayas Digital or its officers, employees or agents responsible for your or other users’ listings, postings or information. We are not liable for misuse, illegal activity or third-party content, and we do not guarantee the accuracy or legitimacy of any listing or information posted by others.

We do not guarantee continuous or secure access to the Services. To the extent permitted by law, we exclude all implied warranties of merchantability, fitness or quality of the Site and our services.

5. Charges for Registration

Initially, Himalayas Digital shall not charge any amount for advertising and distributing information pertaining to goods and/or services on the Site, but such charges may be introduced later and notified through updates on the website.

6. Personal Information

By using Himalayas Digital, you agree to the collection, transfer, storage and use of personal information provided by you on the Site. You also agree to receive marketing communications from us unless you indicate otherwise in writing. Questions may be sent to support@himalayasdigital.com.

7. Updates to this AUP and Other Terms

We may update this AUP or the Privacy Policy at any time and may notify you through posts on the Site and/or email communications. The modified terms shall come into effect immediately. You will also receive an email once a year notifying you of any changes to these Terms.

8. Violations by User

If your listing, posting or information violates any provision of this AUP or the Privacy Policy, we may disable the content, suspend or terminate your access and refuse further use of the Site. We may also remove unlawful information upon receiving notice from a court or appropriate government agency.

9. Third Party Content and Services

Himalayas Digital may provide links to websites operated by third parties. Your use of such websites is at your own risk, and you are responsible for reviewing their own terms and privacy policies. We do not endorse linked websites or the products or services described there.

10. Abuse of Himalayas Digital Services

You agree to inform us if you encounter offensive content or content that violates our policies or infringes intellectual property rights. We reserve the right to take down such content and take reasonable steps to prevent misuse of the Site.

11. Indemnity

You agree to indemnify and hold harmless Himalayas Digital and its affiliates, directors, officers, agents and employees from any claims, demands or legal costs arising from your content, your use of the Service, or your violation of these Terms.

12. Governing Law and Jurisdiction

This AUP and the Privacy Policy shall be governed and construed in accordance with the laws of the Republic of India, and the courts at Himachal Pradesh shall have exclusive jurisdiction over disputes arising out of or relating to the Site.

13. No Buying and Selling of Products or Services by Users

Himalayas Digital is not a platform to buy and sell products or services online. Registered users can list products or services they intend to sell, and users can search for products or services they are interested in buying. We are not responsible for the authenticity of any listed product or service.

14. No Guarantee of Business

Himalayas Digital does not guarantee business from leads generated. We are not responsible if no business or leads are generated for advertisers through premium ads.

15. Himalayas Digital Jobs

As a job-seeker, you agree that Himalayas Digital will not be responsible for any payments made to third parties. As a recruiter, you agree that misuse or fraud on the platform may result in deactivation and further action.

16. Advertiser Obligations

Advertisers agree to make timely payments, comply with applicable laws and provide accurate information. They bear sole responsibility for the quality of their goods and services, and Himalayas Digital bears no responsibility for that quality.

17. Notice of Infringement of Intellectual Property

If you believe that any content infringes your intellectual property rights, you may write to us at support@himalayasdigital.com to request removal in good faith.

18. Himalayas Digital Paid Advertising Services

We strongly recommend exercising discretion and due diligence before availing any products or services. Our paid advertising services do not implicitly or explicitly endorse any product or service.

19. Miscellaneous

Premium ads may be prioritized over free ads, and the sequence of premium ads will be controlled by Himalayas Digital. Unused credits under subscription schemes may be forfeited without refund. Himalayas Digital reserves the right to vary the number of leads delivered against listing packs from time to time without prior notice.
